Display the use of certain biocidal products on a company-specific basis
If you wish to use certain biocidal products in your company in accordance with Section 15c of the Hazardous Substances Ordinance (GefStoffV), you must notify the competent authority of their use.
There are special requirements for the use of certain biocidal products. If biocidal products are to be used that are classified as
- acutely toxic category 1, 2 or 3,
- carcinogenic, germ cell mutagenic or toxic for reproduction category 1A or 1B or
- specifically target organ toxic category 1 SE or RE or
- for which, in addition to the cases mentioned, the user category "trained professional user" has been defined in the authorisation for the intended use,
the employer must notify the competent authority of their first use and the start of renewed use after an interruption of more than one year.
Responsible department
The locally responsible regional councils for company premises on which at least one installation is present,
- which is subject to the EU Industrial Emissions Directive (installations labelled with the letter E in column d of Annex 1 of the 4th BImSchV),
- which is subject to authorisation pursuant to Section 60 (3) sentence 1 no. 2 and no. 3 of the Federal Water Act (WHG) or
- which constitutes an operating area pursuant to Section 3 (5a) of the Federal Immission Control Act (BImSchG) (hazardous incident operation),
- at least one landfill in accordance with Article 10 in conjunction with Annex I of Directive 2010/75/EU of the European Parliament and of the Council of 24 November 2010 on industrial emissions (integrated pollution prevention and control) (OJ L 334 of 17 December 2010, p. 17, as amended). For all other business premises, the responsibility lies
- the municipal administration if the premises are located in an urban district
- the district administration if the premises are located in a rural district.
Please ensure that you submit the notification to the authority responsible for your business premises.

Prerequisite
The biocidal products mentioned may only be used by persons who have the relevant expertise for the biocidal product in question within the meaning of Annex I Number 4.4 of the Hazardous Substances Ordinance. The requirements for expertise depend on the type of product, the applications for which the biocidal product is authorised and the hazard potential for humans and the environment.
By way of derogation from this, instruction relating to the respective use is sufficient instead of expertise, provided that the use is carried out under the direct and constant supervision of a person who is competent for the respective use.
Procedure
After you have made the notification, the competent authority will check the notification and, if necessary, request additional documents. The report is usually not confirmed.
Deadlines
The display
- the first use and
- the start of renewed use after an interruption of more than one year
must be made at least six weeks before the start of use.
Required documents
The following information is required for the notification:
- Name of the applicant and address of the business premises,
- Information on the personnel, premises and safety equipment of the company,
- Information on the type and intended use of the biocidal products or biocidal active substances.

For the use of biocidal products in accordance with Section 15c (1) GefStoffV, which could be carried out without expertise until 30 September 2021, evidence of expertise must be provided by 28 July 2027 at the latest.
